The transfer is governed by specific rules which derogate from the common law regarding succession in the contracts, the supply of credit and debt, in particular as regards the consent of the debtor, derogation from Article .1406 cc since the worker can not resist. The company may be transferred either to act “inter vivos” and “inheritance”, but can also occur both parties agree, whether with a coercive administrative measure or judicial. The transfer business is governed by .2112 cc requiring the buyer to maintain the balance of work and several commitments of the credits earned by workers.
Companies can be classified according to various criteria:
in relation to economic activity;
in relation to;
in relation to the undertaking;
in relation to the entity;
relative to the size.
Classification in relation to economic activity
There are three categories:
delivery: fall into this category all businesses such as family, private associations, and the government, which provide and consume goods and services;
production: includes all companies that produce and acquire goods and services (by definition, this is business)
made public: the groups belonging to the previous two classes, such as the State, the Region, the Province, the City, the local health.
